Heard Shri S.P. Deshpande, learned Counsel for the applicants, Shri V.A. Thakare, learned A.P.P. for respondent no.1 and Shri Anilkumar, learned Counsel for respondent no.1. Parties are present in the court along with their counsel. 2.
On account of a commercial transaction between applicants and respondent no.2, a FIR came to be lodged and consequently a Charge sheet no.106/2015 dated 15.06.2015 under Sections 403, 406, 341, 420 read with Section 34 of Indian Penal Code has been submitted to the Court of J.M.F.C. Court no.9, Nagpur.

Applicants as well as respondent no.2 jointly submit that matter is amicably settled out of Court between them, and hence, the charge sheet and FIR should be quashed and set aside.

We are satisfied that the grievance arose out of a commercial transaction. It is submitted that applicants have also agreed to release the seized material from police custody directly to respondent no.2.

In view of its settlement between the parties, we quash and set aside the Charge sheet mentioned above, as also FIR No. 495/2014, registered with Police Station Pratapnagar. Criminal Application is accordingly disposed of. No costs.
