The learned advocate for the petitioner, on instructions, states that as per the settlement, three cheques worth Rs. 14 lakhs were given to the respondent no. 1 and out of those three cheques, she presented two cheques worth Rs. 10 lakhs and they are encashed. It is stated that the respondent no. 1 has not presented the third cheque worth Rs. 4 lakh.
Accepting the above submission made on behalf of the petitioner and considering the facts of the case, it is
