FEBRUARY 5, 2016 The applicant was arrested in Crime No.286/2015 registered with Police Station, Lakadganj, Nagpur for an offence punishable under Section 307, 34 of the IPC and Sections 4/25 of the Arms Act.
There are in all four accused out of whom, three have been released on bail. Undoubtedly, the present applicant is the person who has actually stabbed the victim by means of knife and the injury caused were dangerous to his life. The fact remains that the victim survived and obviously is living at his residence in Nagpur.
Insofar as the applicant is concerned, by asking him to remain out of Nagpur District, he can be released from jail since there is no likelihood of his trial commencing soon.
ba930.15 In that view of the mater, following order is passed.
ORDER
(i) Criminal Application (BA) No.930/2015 is allowed.
(ii) Applicant-Chandrashekhar @ Chandu s/o Rambhau Durugkar, be released on bail in Crime No.286/2015 registered with Police Station, Lakadganj, Nagpur for an offence punishable under Section 307, 34 of the IPC and Sections 4/25 of the Arms Act on he executing P.R. Bond in the sum of Rs.20,000/- with one surety in the like amount. (iii) The applicant shall not enter Nagpur District of Nagpur till the trial is completed except for attending the Court.
(iv) Mr. Bhangde, learned counsel for the applicant undertakes that the applicant shall not apply for modification of this order till the trial is completed.
