02] By the present applications, the applicants/appellants seek condonation of delay in setting aside the abatement order and bringing the legal heirs on record.

03] The learned Counsel appearing for the legal heirs of the non-applicants/respondents has no objection.

04] In view of the reasons mentioned in the applications, the delay in filing the application for setting aside abatement order and for bringing the legal heirs on record is condoned. Since the right to sue survives against the sole respondent, abatement is set aside. Permission is granted to bring the legal heirs of respondent No.1 on record.

Cross Objection No.46/2016:

On the oral motion, permission to bring the legal representatives of the sole respondent on record in the cross objection is granted.
