DATE : March 17, 2017 As the applicant has deposited entire amount of compensation in this Court, the execution of the impugned award shall remain stayed during pendency of the appeal. Civil application is disposed of. C.A.F. No.1195 of 2017 The claimants seek permission to withdraw the amount of compensation deposited by the appellant.

Considering the nature of evidence on record, the claimants are permitted to withdraw an amount of Rs.Ten lakhs on filing an undertaking that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct. Further amount of Rs.Ten lakhs is permitted to be withdrawn on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial). Remaining amount shall be invested in Fixed Deposit.
