The petitioner-Co-operative Society has approached this Court seeking appropriate directions in the matter of effecting deductions of loan installment for its borrowers-members pursuant to the loans advanced by it.
While issuing notice in the writ petition the respondent nos. 2 and 3 were directed to resume the system of deducting monthly installment as per the practice prevailing earlier. In the affidavit dated 21.09.2022 filed on behalf of the respondent no.2 it has been stated in paragraph 4 as under: "I state that from April, 2020 the procedure for loan recovery and credit to Co-operative Societies is as follows: (i) Commissioner, ICDS, receives online data of attendance and loan recovery from District Programme Officer, Zilla Parishad, Women and Child Development/Child Development Project Officer(Urban).
(ii) Commissioner recovers the loan
912-WP-6670-2018.odt 2 installment and pays it to Credit Co-operative Societies through District Programme Officer, Zilla Parishad, Women and Child Development/Child Development Project Officer(Urban).
(iii) The loan recovery for the month of August,2022 has been done and transferred to the concerned District Programme Officer, Zilla Parishad, Women and Child Development/Child Development Project Officer(Urban) for crediting the same to Co-operative Societies.
(iv) At district level the District Programme Officer, Zilla Parishad Women and Child Development/Child Development Project Officer(Urban) is the controlling officer for loan recovery. The Child Development Officer (Urban) is responsible for payment of loan deducted amount by depositing in the respective bank account of credit society.
It is informed by the learned counsel for the petitioner that presently this mode of recovery is being followed and the petitioner has no grievance with the same. The petitioner would not have any grievance, if the same is continued. In view of aforesaid, by accepting the statements made in paragraph 4 of the aforesaid affidavit and by directing the respondent no.2 to continue that practice further, the writ petition is disposed of. No costs.
