DATED : 01-08 - 202 Vide order dated 18-7-2023, we had requested learned Assistant Government Pleader Mr. Pathan to ascertain from the Education Officer (Secondary), Zilla Parishad, Nagpur as to the exact status of the pension case of the petitioner.

Mr. Pathan informs us that the petitioner himself issued request communication dated 18-5-2023 requesting that the pension papers be forwarded to the Treasury, Washim instead of Treasury, Nagpur. We have perused the said communication dated 18-5-2023. The Education Officer appears to have informed the petitioner that the proposal shall be duly sent to the Treasury at
2 c.p. 350.2022.odt Washim after the management complies with the formalities. It appears that the management did not complete the formalities which forced the Education officer to issue letter dated 16-6-2023 to the Head Master of the school which letter also we have perused.

Learned counsel for the management Mr. Paliwal states that all deficiencies are removed and an appropriate proposal is now forwarded to the Education Officer including that of leave encashment. We accept the statement.

We are further told by Mr. Pathan that the proposal is already sent to the Treasury at Washim and the petitioner shall receive the pension from the Treasury, Washim. We accept this statement also. 5.
We drop the contempt proceedings.
