(1) 16.899.2018
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR WRIT PETITION NO.899 OF 2018 Vishnu Shankarrao Joshi Vs. Dashrath Shivram Chudhari and others --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Mr. S. R. Deshpande, Advocate for petitioner. Mr. B. M. Kharkate, Advocate for respondent Nos.1 to 5. CORAM :
AVINASH G. GHAROTE, J.
DATE : 26/10/2021 Both the learned counsel for the parties are agreeable that the application for amendment as filed by the petitioner before the learned Maharashtra Revenue Tribunal, Nagpur dated 08.03.2016 has not been decided as yet, in view of which, it is necessary that the said application for amendment has to be decided one way or the other by the said learned Tribunal. This being the position, the apprehension of learned counsel for the petitioner that the same would not be so decided, is clearly unfounded.
The application for amendment of the Memo of Revision would be decided by the learned Maharashtra Revenue Tribunal by one way or the other, however, parties would be at liberty, to address the learned Maharashtra Revenue Tribunal, on the merits of the application for amendment.
In view of the above, the petition is disposed of in the above terms.
JUDGE Sarkate
