Perused the charge-sheet as well as FIR.

The principal accused is Ashish Bilone, against whom there are direct allegations about the offence in question by the girl below 18 years of age. So far as the present applicant is concerned, he is an accomplice and has actively helped the present accused. But there are no allegations against the present applicant about commission of the main offence. Further, learned counsel for the applicant makes a statement that till the trial is over, the applicant shall not enter Lakhni Taluka.

In view of above, following order is passed.

ORDER

(i) Criminal Application No.934/2015 is allowed.

ba934.15 (ii) Applicant-Suraj Gopal Meshram, be released on bail in Crime No.40/2015 registered with Police Station, Adyal, Dist.Bhandara, for an offence punishable under Sections 363, 376 (I) (J), 506 read with Section 34 of the IPC and Sections 4, 8 and 12 of the POCSO Act, on he executing P.R. Bond in the sum of Rs.10,000/- with one surety in the like amount. (iii) The applicant shall not enter the Lakhni Taluka and shall inform his place of residence to Police Station, Adyal.

(iv) The applicant shall not tamper with the prosecution evidence.
