DATED : NOVEMBER 29, 2019 At the outset Mr. Tembhare, learned Additional Public Prosecutor for non applicant -State makes a statement that investigating officer has filed final report before the Court of law.

On getting such statement Mr. Kapse, learned counsel for the applicant submits that the applicant be permitted to withdraw this application with liberty to file an application for bail afresh before the Court below. The application is disposed of as withdrawn with liberty to file an application afresh before the Court below in view of the changed circumstance i.e. filing of the charge-sheet. The learned Judge of the Court below shall decide the said application on its own merit in accordance with law.

It is made clear that this Court has not heard the case of the present applicant on its own merits. JUDGE srwagh
