DATE : 11.03.2016 By this petition, the petitioner seeks protection of his services, in view of the judgment of the Full Bench, reported in 2015 (1) Mh.L.J. 457.

The learned Assistant Government Pleader states that no relief whatsoever could be granted in favour of the petitioner as the petitioner has tendered a fabricated caste validity certificate to the respondent - employer in support of his caste claim and has secured promotion on the basis of the same. It is stated that a departmental enquiry was conducted against the petitioner in this regard and the services of the petitioner have been terminated after the charges levelled against the petitioner were held to be proved. It is stated that no relief may be granted

1103wp1394.16.odt in favour of the petitioner in the aforesaid set of facts, when the petitioner had neither approached the employer with clean hands nor has approached this Court with the same.

When we pointed out that we are not inclined to grant any relief whatsoever to the petitioner in the aforesaid set of facts, the learned Counsel for the petitioner seeks permission to withdraw the writ petition.

Permission to withdraw the writ petition is granted. The writ petition is disposed of as withdrawn. JUDGE JUDGE Wadkar
