Heard Shri P.K. Mishra, learned counsel for the applicant. Nobody appears for the respondent, though duly served.

We find that the reasons stated in the application are sufficient enough to exercise the powers to condone the delay. Accordingly, we are of the view that this application deserves to be granted, of course, subject to payment of cost in the matter.

The delay is condoned. The application is allowed subject to payment of cost of Rs.1,000/- to the Vidarbha Lady Lawyers Association, Nagpur, within a period of two weeks from the date of order, failing which this order shall stand revoked automatically without reference to Court.

If the costs are paid within the stipulated time, Family Court Appeal be restored to original file and thereafter fresh notice be issued to the respondent, returnable in two weeks from the date of restoration of Appeal.
