Heard Mr. N.B. Kallwaghe, the learned Counsel for the applicant.

The learned Counsel for the applicant submits that the attempt of the applicant approaching the learned Sessions Judge, Buldhana by filing an application seeking enlargement on bail failed in view of the order passed by the learned Session Judge, dated 06/11/2014 and as such the applicant was before this Court. He further submits that during the pendency of the present application, the co-accused viz. Nandabai Sawale approached the learned Sessions Judge and her application was allowed by order dated 08/01/2015. He further submits that as the applicant is on a similar footing to Nandabai Sawale, the applicant be permitted to withdraw the present application with liberty to file an application before the learned Sessions Judge, since the applicant can make an attempt to pray for enlargement on bail claiming parity with Nandabai.

ba.871.14 2/2 Perused the order passed by the learned Sessions Judge on 08/01/2015 on the application of Nandabai Sawale. In view of the submissions of the learned Counsel for the applicant, the application is allowed to be withdraw, as prayed for.

Needless to state that the learned Sessions Judge to consider the application of the applicant on its own merits. JUDGE *sdw
