This is an application filed by the applicant for grant of regular bail in connection with Crime No. 258/2025 registered on 21.02.2025 registered with non-applicant Police Station Wardha City, District Wardha for the offence punishable under sections 137(2), 64(2)(i), 64(2)(m), 64(2) (j), 87, 143(2)(3)(4), 351(2),115(2), 352, 3(5), 318(4), 336(3), 340(2) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 4, 6, 16 and 17 of the Protection of Children from Sexual Offences Act,2012 against the present applicant.
2. The prosecution case in brief is that, the mother of the victim has lodged the report stating that she is residing with her daughter-victim. On 01.02.2025 victim told her that she is going with Pratiksha Pendor of Nimgaon (Sabane) for
2 / 4 40-ba 1156-25 catering work and she left the house. On 19.02.2025 the complainant received a call from victim and she stated that she is at Ujjain and she is not allowed to return to her house at Nalwadi, Wardha. Based on these allegations, the offence came to be registered.
3. It is submitted that, the applicant and Munshi Shaha and Ruksana @ Khala prepared bogus Aadhar Card by pasting photograph of victim girl and they performed marriage of victim with Sukhlal. Victim also named this applicant in her statement. Victim has stated that when she tried to contact her mother, she was beaten by accused Jyoti. It reveals that the applicant and other accused had performed the marriage of five girls in this way by taking money from bridegroom. It is revealed in the investigation that the marriage of victim was performed after preparing her bogus Aadhar Card. Other accused Munshi Shah had taken money from brother of Sukhlal for this marriage.
4. The learned counsel appearing for the applicant has stated that the role of the applicant is that she has forged Adhar card of this applicant. The other co-accused are released on bail. Custody of this applicant is not required. Hence, prayed to release the applicant on bail.

5. Learned APP opposed the application and stated that this is a case of human trafficking, the applicant has forged Adhar Card, took her to Registrar Office and Registered marriage was performed. On the basis of false certificate, she was shown as major. When she was in custody, the amount was recovered from her, Considering her role and the gravity of the offence, prayed to reject the application.
6. The learned counsel for the non applicant No.2 has stated that marriage of other four poor girls is also performed by the said group of persons. They are doing human trafficking and main role is of this applicant, she has introduced the other girls under the pretext of job. She has performed marriage of Mohammad and has taken the amount. Considering the allegations made against this applicant, prayed to reject the application.
7. Heard both the sides and perused the record. On perusal of the said FIR, it appears that it is the case of human trafficking. Though the role of this applicant is mentioned, is about forging the Adhar card, she has introduced five girls and thereafter they forcibly performed their marriage and took amount from the persons. It appears that group of persons are doing this activity, which comes under human trafficking. Considering the allegations made
4 / 4 40-ba 1156-25 against this applicant, this is not a fit case to release the applicant on bail. Hence, the application stands rejected and disposed of.
