By this application, the applicant is seeking anticipatory bail in connection with Crime No.1232/2023 registered with Police Station Gadge Nagar, Amravati for offences punishable under Section 394 of the Indian Penal Code.

The applicant is apprehending arrest at the hands of police as crime is registered against the present applicant on the basis of report lodged by Pankaj Laxmanrao Ahuja who alleged that he is vegetable vendor. On 07/10/2023, at about 10.30 to 10.45 p.m. when he was proceeding by his car, he was restrained by the present applicant who was holding iron fighter in his hand and he snatched the amount of Rs.5000/- and also gave a blow of such fighter on his face.

On the basis of said report, police have registered the crime against the present applicant.
Learned Counsel submitted that the weapon of the alleged offence is already seized by the police. The amount is also recovered. Now interrogation of the present applicant by taking him in the custody is not required. In view of that he be released on anticipatory bail. He further submitted that he has cooperated with the investigating agency and he has attended the police station.

Said application is strongly opposed by the State on the ground that the offence is of serious nature. Though the amount and the weapon is seized, custodial interrogation of the present applicant is required and prays for rejection of the application.

Having heard learned Counsel for the parties. Perused the investigation papers. It reveals that the incriminating article i.e. weapon is already recovered, amount is also recovered. After the applicant was protected by granting ad-interim protection, he has cooperated with the investigating agency. In view of that the application deserves to be allowed. Hence I proceed to pass the following order :
(i) The application is allowed.
(ii) In the event of arrest, the applicant - Ravi Rajendra Tejwani in connection with Crime No.1232/2023 registered with Police Station Gadge Nagar, Amravati for offences punishable under Section 394 of the Indian
Penal Code, be released on anticipatory bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) The applicant shall attend the concerned police station as and when required by the Investigating agency for the investigation purpose.
(iv) The applicant shall furnish his Cell phone number and address with address proof before the Investigating Officer.
(v) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
