Heard learned counsel for the applicants and learned Additional Public Prosecutor for the State.

Perused the counter F.I.Rs. lodged by the parties to this application. Upon perusal of both F.I.Rs. we are unable to make assessment of the grievances made by both the parties. Mr.Thakkar, learned counsel for the applicants, submits that the some of the applicants are students and their career would be affected. Even if it is true, fact remains that we are unable to make assessment of evidence collected by the prosecution and the only way is to grant liberty to the applicants to apply for discharge to the trial court after filing of the charge-sheet . That being so, we make the following order.

ORDER

Criminal Application (APL) No.765 of 2014 is disposed of reserving liberty in favour of the applicants to apply for discharge if so advised, after filing of the charge-sheet. If such an application for discharge is made, the same shall be disposed of expeditiously and in any case within a period of four months from today. JUDGE JUDGE Chute.
