30th November, 2018 Heard learned counsel for the applicant-appellant and learned Addl. Public Prosecutor for the respondent. We have gone through the evidence of the sole eye-witness and other circumstantial evidence. Although there are some discrepancies in what the eyewitness, PW 1, who is the mother of deceased daughter, says, and her evidence in the Domestic Violence proceedings, at this stage, these discrepancies could not be seen creating a whole lot of doubt about credibility of PW 1. That apart, conduct of the appellant, at least, at this stage, does not appear to be natural. It cannot be ignored that the appellant is the father of the deceased. The deceased daughter was about one-and-
half-year old at the time of her death. Her mother has said many incriminating things against the appellant, who is her husband. The Post-mortem Report appears to be supporting the version of eye-witness. At this stage, it is not possible for this Court to take a detailed account of entire prosecution evidence and this Court would, upon broad consideration, find that this is not a fit case for grant of bail. Of course, these are the observations based upon prima facie impressions of this Court.
In the result, the application stands rejected. -0-0-0Criminal Appeal No. 597 of 2018 :
