2] Dwarkabai filed claim petition under the Motor Vehicles Act as her husband Dharmik, a labour, died in an accident on December, 31, 2008. Respondent No.4 to the claim petition (Girjabai) is mother of Dharmik being dependent. Girjabai died when the claim petition was pending. As such, the appellant was brought on record as legal heir of Girjabai being her son.
3] Whether the appellant is entitled for compensation payable to Dwarkabai is an issue which is required to be appreciated. Case for consideration is made out.
