Heard.

The State Govt. has imposed prohibition in the district of Chandrapur. Despite that, liquor is smuggled to the district from other neighbouring districts. The applicant in this application is a habitual smuggler of liquor in spite of prohibition. In his order, the Trial Judge has observed thus in respect of present Applicant:- "4.

............................................................ ............In the present matter record shows that accused is not a simple layman or a common man. He was facing various types of cases in past. No doubt he was acquitted out of these 3 cases but one recent case as per CIS report bearing SCC No.1150/2015 is still pending against him. Aforesaid case is a recent one and thereafter the present case is registered against him. All these legal and factual aspect which shows that

discretion to grant anticipatory bail cannot be exercised in present matter. ....."

I agree with the above reasons.

Hence Criminal Application [ABA] No. 657 of 2015 is rejected.
