Heard Shri N.A. Gaikwad, learned counsel for the petitioner, Shri Jagtap, learned counsel for respondent Nos. 1 & 2 and Shri S.D. Sonak, learned AGP for respondent No. 3.

The petitioner could not succeed in open tender and effort in this petition is to urge that she is ready and willing to offer the amount as per offer of Respondent No. 4 or even more amount.

Shri Jagtap, learned counsel submits that Respondent Nos. 1 & 2 have taken possession of resort and handed over to Respondent No. 4.

After hearing the respective counsel, we find that several disputed questions arise. The petitioner cannot at this stage and in this petition assail grant of contract to Respondent No. 4.

Hence, with liberty to the petitioner to take such other steps as are open in law, we dispose of the present writ petition. No order as to costs.
