Apprehending arrest in connection with Crime No.295/2018 registered by the non-applicant against two accused (including the applicant) for the offence punishable under Sections 452, 376, 506 read with Section 34 of the Indian Penal Code, the applicant seeks pre-arrest bail.

The applicant has stated in paragraph No.4 of the application that earlier also the complainant had lodged complaint against the applicant and his parents and son on 23rd January, 2018 and a non-cognizable offence was registered against the applicant and his family members. The accusations against the applicant are that the applicant had caught hold of hand of the victim and because of the force used, she suffered multiple abrasion and swelling on her wrists. The applicant is granted interim protection by

2 aba708.18 order dated 5th October, 2018. The investigating agency has not made any complaint that the applicant has misused the liberty granted by this Court.

Considering the facts of the case, nature of accusations against the applicant and the history of enmity between the parties, as recorded earlier, the interim order granted on 5th October, 2018 is confirmed. The application is allowed accordingly.
