DATED : NOVEMBER 27, 2019 Heard Mr. M.N. Ali, learned counsel for applicant and Mr. J.Y. Ghurde, learned Additional Public Prosecutor for the non applicant-State. Also perused charge-sheet which is placed on record along with application for regular bail. The charge-sheet contains crime chart of the present applicant which shows that applicant is accused in 9 cases of similar nature i.e. offences punishable under the provisions of Maharashtra Prohibition Act. Chandrapur district is a dry district in which transporting, possession and selling of any type of liquor is prohibited.
The crime chart shows that after releasing on bail, the applicant has an inclination to repeat the offence. After hearing and after perusing the charge-sheet, when the Court was about to dismiss the application for bail, Mr. Ali, learned counsel for the applicant submits that he has instructions from the applicant to withdraw the present application.
ba1023.19.odt The applicant is in jail. His case is triable by Court of Judicial Magistrate First Class, Chandrapur and it is already registered as Regular Criminal Case No.2752/2018, is the statement of the learned counsel for the parties. In that view, I pass the following order:
ORDER
(i) The application is dismissed as withdrawn.
(ii) Since application is withdrawn by the applicant, this Court is not giving detailed reasons for its dismissal. (iii) Regular Criminal Case No.2752/2018 pending on the file of learned Judicial Magistrate First Class, Chandrapur should be decided as expeditiously as possible and preferably within a period of one year from today. The application is disposed of.
