DATED : 05/10/2018 Apprehending arrest in connection with Crime No. 433/2018 registered by the non-applicant against the four accused (including the applicant) for the offences punishable under Sections 324, 323, 504, 506, 552 r/w Section 34 of the Indian Penal Code, the applicant seeks prearrest bail. According to the Investigating Agency, all the accused committed house trespass, forcibly entered the house of the complainant, some of the co-accused were armed with stick and sword, and abused and assaulted the complainant, his mother and his wife.

The application is opposed on the ground that the applicant is habitual offender and atleast 12 crimes/offences are registered against him in the last 11-12 years. The Investigating Agency further opposes the application on the ground that investigation is still in progress.

2 aba709.18 Considering the facts of the case, I am not inclined to grant the prayer made in the application. The application is dismissed. No costs.
