By this application, the applicant seeks recall of the order dated 10.10.2017 dismissing the petition for want of prosecution.

Despite service, none appeared for the respondent no.1 on 14.12.2017 as well as today. Accordingly, for the reasons set out in the application, the application is allowed. The order dated 10.10.2017 is recalled and the writ petition is restored back to its original file subject to payment of costs of Rs.1,000/- in the High Court Legal Services Sub Committee, Nagpur on or before 06.01.2018.

If the costs are paid, the matter be listed for final hearing in the week commencing 8th of January, 2018. Accordingly, the application is disposed of on the aforesaid terms.
