Heard Advocate Shri Madane for the applicant. The applicant is languishing in jail since last ten months. There is no material evidence against him. Hence, prays to grant bail. Learned APP Shri H.R. Dhumale, has pointed out order dated 30.08.2018 passed in Criminal Application No.726/2018 and submitted that the applicant withdrawn the said application. Learned APP has submitted that two persons identified the present applicants, who are sitting the vehicle after breaking the ATM machine. Out of seven accused, three accused are in jail. There is no dispute that investigation is complete and charge-sheet is filed before the learned J.M.F.C. Mouda. Hence, the following order:
Looking to the gravity of the offence applicant is not entitled for bail.
Hence, the application is rejected. However, the
ba910.18.O.odt 2 learned Trial Court is directed to decide the trial expeditiously. The learned J.M.F.C. Mouda is directed to commit the case for trial after compliance of the provisions under section 207 of Cr.P.C.
