CORAM

:

A.B. CHAUDHARI AND P.N. DESHMUKH, JJ.

DATE :

20th January, 2015.

Heard learned counsel for the rival parties.

This is a Petition for grant of furlough. We, however, find from Para 2 of the Affidavit-in-Reply, and particularly the chart given therein, that the petitioner himself had surrendered earlier on two occasions, but on the last occasion, he was required to be arrested after a period of seventy-three days for unauthorized absence from parole leave.

Learned APP states that in the remarks column of the item at Sr. No.3 of the said Chart, due to typographical error, correction is required to be made in the date, namely "19.2.2012", which should be read as

"19th February, 2014." We accept the oral submission made by learned APP that the date should be 19th February, 2014. Learned APP is permitted to carry out the necessary correction in the reply by amendment. In view of the above, we are not inclined to entertain the present Writ Petition. Hence we make the following order:-

O R D E R

Criminal Writ Petition No. 1024 of 2014 is dismissed.

Fees payable to learned Adv. Ms. Bhatia [appointed] for the petitioner are quantified at Rs. 1500-00 [rupees one thousand five hundred only]. Judge Judge |Hedau|
