This is an application for suspension of sentence awarded by the learned Additional Sessions Judge, Wardha. The accused have been convicted and sentenced for more than one offence. The sentence of seven years rigorous imprisonment has been awarded for the major offence of Section 307 of the Indian Penal Code.

I have gone through the record and proceedings. Perusal of the judgment would show that the conviction and sentence is based on the evidence of the injured eye witnesses. The accused assaulted the informant and the

31 appa.1164.2023.odt witnesses with dangerous weapons like sword, knife, iron rod and hockey sticks.

On going through the reasons recorded by the learned Judge, I am of the view that this is not a fit case to suspend the sentence. At the most, in this case, the office can be directed to prepare the paper book expeditiously so that matter can be heard. In view of this the application is rejected. The preparation of paper book is expedited.

The criminal application stands disposed of, accordingly.
