Heard Shri R.D. Karode, learned Counsel for the applicant, Mrs. K.S. Joshi, learned A.P.P. for respondent no.1 and Shri R. Wakode, learned Counsel for respondent no.2, for some time.

Learned counsel for applicant informs that the applicant has sought an adjournment as he wants to engage a Senior Advocate.

Learned A.P.P. however submits that charge sheet in the matter is already filed on 02.05.2016, and hence the applicant can always move appropriate application before the trial Court.

We have considered the controversy. The reply affidavit is already placed on record by respondent no.1 on 26.02.2016.

As the charge sheet is already filed, we do not find it appropriate to record anything on the merits of the controversy. Hence, keeping all rival contentions open and with liberty to the applicant to file appropriate application before the trial Court, in accordance with law, we dispose of the present Application. No costs.
