By this application, the applicant is seeking bail under Section 439 of the Code of Criminal Procedure. 2.

After hearing the learned counsel for the applicant for some time and on expressing that this Court is not inclined to allow this application, he seeks permission to withdraw the present application. He further prays for grant of liberty to file fresh application, in case, there is no substantial progress in the trial, in next one year. 3.

Permission to withdraw the application is granted with liberty to move fresh, if there is no progress in the trial, in next one year.

The criminal application is disposed of as withdrawn.
