In the present matter by an order dated 25th September, 2024, services of petitioner has been transferred from Municipal Council, Karanja, District Washim to Municipal Council, Darwha, District Yavatmal. This order of transfer is the subject matter in pending O.A No. 1069 of 2024 before Member, Maharashtra Administrative Tribunal, Nagpur.

By the impugned order dated 22nd October, 2024, learned Tribunal though recorded perverse finding that services of petitioner being not transferred out of Municipal Council, but fact remains that as per transfer order dated 25th September, 2024, petitioner was already relieved from the post of Junior Engineer (Mechanical) and in his place one Shri Pratik Rambhau Watane had joined the post. It is further stated by learned counsel appearing for Municipal Council, Karanja that said Pratik R. Watane is presently working on the post. However, he is not made party to the present petition.

Petitioner in addition to the observation of learned Tribunal for rejecting interim relief also raised several grounds to substantiate his submission. However, as the main petition is pending before learned

3/3 Tribunal, it will not be justified to consider the merits of the matter at this stage of petition.

In the scenario it will be expedient to direct the learned Tribunal to decide the pending O.A. No. 1069 of 2024 as expeditiously as possible.

Hence, accordingly learned Member, Maharashtra Administrative Tribunal, Nagpur is requested to decide the pending O.A. No. 1069 of 2024 as expeditiously as possible and in any case, within a period of two months. All the parties are directed to cooperate the Tribunal to decide the application by submitting their affidavit-in-reply and avoid to obtain unnecessary adjournment in the matter. 7.
