DATE : 08-03-2023 The respondent has filed pursis on record bearing St. No.02/23, undertaking that he shall not execute the decree regarding the arrears of rent, which statement is accepted as statement to the Court.

In view of this statement, the decree regarding arrears of rent does not survive. The finding regarding the bonafide need, in view of what has been recorded in the order dated 03-03-2023, is hereby confirmed.

The petition is accordingly partly allowed in the above terms by confirming the judgment of the Courts below regarding eviction on the point of bonafide need. JUDGE Deshmukh
