DATE : February 02, 2018 The petitioner has filed this contempt petition on account of non-compliance of the directions issued by this Court in Second Appeal No.338/2011. By that order the State of Maharashtra through Collector, Wardha was directed to hand over possession of the suit field to the present petitioner within period of one month and on failure to do so it was directed to pay costs of Rs.25,000/-.

During pendency of the present proceedings possession of the suit filed has been handed over to the petitioner on 31/12/2017. An amount of Rs.25,000/- has been deposited in this Court on 24/01/2018. The affidavit in that regard has been placed on record.

Accepting the aforesaid I do not find any reason to keep the present petition pending. The Contempt Petition is disposed of. It is open for the petitioner to withdraw the amount of Rs.25,000/- deposited by respondent No.1 in this Court.
