On 27th February, 2023, following order was passed: "

The learned counsel instructed by Mr.A.M.Tirukh, learned counsel for the Respondent No.2 submits that Vakalatnama has been filed for the Respondent No.2. 2.

The appellant/applicant to remove office objections within a period of one week from today, failing which, he shall deposit cost of Rs. 1000/- with the Registry, which in turn, shall be paid to the High Court Legal Services Sub Committee, Nagpur. 4.

Stand over to 13th March,2023."

2. The applicant has neither removed office objection/s nor paid the costs.

3. The applicant by the present application is seeking leave to file under Section 378(4) of the Criminal Procedure Code. According to Registry there is a delay and the applicant ought to have filed the application seeking condonation of delay. The said objection has not been removed.

4. It appears that the applicant is not interested in prosecuting the application and therefore has not taken necessary steps in that regard.

APPA.1140.22 The instant application is therefore dismissed for want of noncompliance of the order dated 27th February, 2023.

5. The Registry to proceed further to recover the costs in accordance with law.
