The petitioner has impugned herein the order passed by the Revenue Officer under Section 48(8)(2) of the Maharashtra Land Revenue Code, 1966 (the M.L.R. Code) about seizure of vehicle and imposing penalty for use of J.C.B. and illegal excavation of minor minerals. The said order was challenged before the Additional Collector, however it was rejected. 3.

It is not in dispute that the Second appeal under Section 247 of the M.L.R. Code would lie before the Additional Commissioner, which is efficacious remedy.

In view of above, I am not inclined to entertain the petition.

If the appeal is filed before the Additional Commissioner within two weeks from today, then it

The petition stands disposed of in above terms. No order as to costs.
