DATE : APRIL 24, 2015 Prayer is to permit the present appellant to withdraw the amount of Rs.25,000/- that was deposited by it under the provisions of Section 173(1) of the Motors Vehicles Act, 1988.

In the application it is stated that the appeal filed by the present appellant has been allowed by judgment dated 10/11/2014.

Considering the judgment of learned Single Judge in Prakash v. Pramod & Ors. 2004 ACJ 896, the prayer as made in the application is granted. The appellant is permitted to withdraw amount of Rs.25,000/- that was deposited on 29/06/2011 along with amount of interest accrued thereon. Civil application is allowed and disposed of.
