Shri Joshi, learned Additional Public Prosecutor by referring to para 6 of the affidavit-in-reply submits that on completion of investigation, "A" summary report is filed before trial Court and same is pending for consideration.

In that view of the matter, though respondent no.2 is not present, we dispose of the application being infructuous due to filing of "A" summary report before trial Court granting liberty in favour of respondent no.2 to contest the same, if found necessary.

At this stage, Shri Nafde, learned Counsel for applicant, submits that "A" summary report is pending before trial Court since 2017 and, therefore, trial Court may be directed to dispose of the matter expeditiously.
