DATED : 18/03/2020 An attempt was made by the learned counsel appearing for the revision applicant to contend that the present revision application was maintainable against the impugned judgment and order dated 21/12/2017 passed by the Reference Court. Reliance was placed on judgment of this Court in the case of Kawadu Madhav Bansod vs. State of Maharashtra and another, 2004 (4) Bom. C. R. 495.

After arguing for some time and when the impugned judgment and order was perused by this Court, which indicates that the Reference Court had applied its mind to the material that was available on record while dismissing the Reference, the learned counsel for the applicants sought permission to withdraw the present application with liberty to file appeal for challenging the impugned judgment and order.

In view of the above, the revision application is disposed of as withdrawn with liberty to the applicants to file appeal in order to challenge the impugned judgment and order passed by the Reference Court. JUDGE KOLHE/P.A.
