DATE : April 21, 2017 It is the contention of the petitioner that the respondent/Scrutiny Committee has invalidated her caste-claim on the ground that the petitioner did not appear on the date of hearing. It is further contended that the petitioner did not receive the notice of hearing and as such she could not remain present on the date of hearing.
In that view of the matter, we remand the matter to the respondent/Scrutiny Committee. The petitioner shall remain present before the Scrutiny Committee on 02/05/2017. The Scrutiny Committee shall decide the claim of the petitioner within a period of two months from the date of petitioner's appearance before it. In the meantime, there shall be status-quo in respect of the petitioner's post of Member of
934-WP-5739-16 2/2 Grampanchayat till the respondent/Scrutiny Committee decides the claim of the petitioner.
Petition is disposed of in aforesaid terms. No costs. Pending C.A.No.173/2017 is also disposed of accordingly.
