DATE : 13.02.2015 The petitioners allege the non-compliance of the order passed by the Industrial Court in complaint filed under Section 28 read with Items 5, 6 and 9 of Schedule IV of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971.

Shri Abhay Sambre, the learned Advocate for the respondent submits that the petitioners have appropriate remedy under the provisions of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971. Shri Bhushan Mohata, the learned Advocate for the petitioners does not dispute this position.

In view of this, I am not inclined to invoke the jurisdiction under the Contempt of Courts Act, 1971. The Contempt Petition is disposed of with liberty to the petitioners to seek redressal of their grievance in appropriate proceedings, if so advised.
