The record shows that the appeal filed by the Insurance Company is dismissed long back on 13.6.2017 for non payment of cost. Thereafter, no steps are taken in the matter to restore the appeal.

According to respondent no.1, the amount deposited by appellant is lying with the Commissioner for Workmen's Compensation, Yavatmal.

For the reasons stated in the application, the application is allowed.

Respondent No.1 is permitted to withdraw the balance fifty percent amount along with accrued interest thereon deposited with the Commissioner, for Workmen's Compensation, Yavatmal.

Application stands disposed of.
