The applicant-appellant has filed an application for restoration of appeal which was dismissed for failure on the part of the appellant to file private paper book. This is accompanied by an application for condonation of delay of 1436 days in filing the application for restoration. Upon perusing the contents of the said applications, I am inclined to allow the same thereby condoning the delay and restoring the appeal on the condition that the appellant shall deposit costs of Rs.5000/- (Rs. Five Thousand) with the High Court Legal Aid Sub Committee, Nagpur, within a period of four weeks from today. It is submitted by the learned counsel appearing for the appellant that the private paper book is ready and it shall be placed on record within a period of two weeks from today.
