DATED : 10-02-2015 The respondent No.1 is permitted to withdraw 50% of the amount deposited by the appellant, on furnishing solvent surety to the satisfaction of the learned Registrar (Judicial). The balance 50% of the amount shall be given to the respondent No.1, on filing an undertaking to the satisfaction of the learned Registrar (Judicial) of this Court to the effect that if it is found at the time of hearing that the respondent No.1 is not entitled for the amount given to him, the respondent No. 1 shall redeposit it with the Registry of this Court with interest as would be determined by this Court, within the stipulated time.
The civil application is allowed in the above terms.
