The only prayer made by the petitioner in the instant petition is for a direction against the respondent no.2Commissioner of State Excise, to decide the Appeal filed by the petitioner, under Section 137(2) of the Maharashtra Prohibition Act, at the earliest.

It is stated on behalf of the petitioner that though the Appeal under Section 137(2) of the Act was filed by the petitioner before the Commissioner of State Excise on 18th August, 2016, the same is not decided, till date. Since the prayer made by the petitioner is innocuous, we dispose of the Writ Petition, with a direction to the respondent no.2- Commissioner, State Excise, to decide the Appeal filed by the petitioner, if not decided, as early as possible and positively within four weeks, especially when the matter is closed for

Order accordingly. No costs.
