Heard.

The applicant has sought pre-arrest bail in the crime registered against him for the offence punishable under Section 65(e) and 83 of the Maharashtra Prohibition Act, 1949 and under Section 188 of the Indian Penal Code. This Court has passed order on 25th November,2016 granting interim protection to the applicant. I find that the applicant has not made statement in the application to the effect that he had not been involved in any other crime/ offence earlier. As according to me, this is one of the relevant consideration while deciding the application under Section 438 of the Code of Criminal Procedure and the applicant has not made any statement in that regards, the application is dismissed. The applicant is granted liberty to file fresh application, if so advised.
