It is argued that the petitioner has filed the first appeal challenging the judgment and decree dated 11.02.2019 passed by the trial Court. It is submitted that the said proceeding is pending for condonation of delay. 2.

In that view of the matter, I am of the opinion that, end of justice would be sub-served if the liberty is granted to the petitioner to raise the grounds raised in this writ petition, in the said first appeal.

Accordingly, the writ petition is disposed of. 4.

All the points are kept open to be raised in the first appeal.
