By this petition, the petitioner seeks a direction to the respondent Nos.1 to 4 to repair the existing approach road of length 80 meters and concrete or tar the same within a time frame and submit the action taken report before this Court. On a perusal of the photographs that are annexed to the petition and also the photographs that were tendered to this Court at the time of hearing of the writ petition, it appears that the petitioners are required to commute on the approach road temporarily, as a large cement concrete road is being constructed for commutation, as could be seen from the photographs at pages 21 and 22. As a stop gap arrangement, the members of the petitioner-Association may be required to face some difficulties.
If the petitioners are desirous that the temporary road should be tarred, the petitioners can ventilate the grievance before the appropriate authority. However, in the circumstances of the case, a direction cannot be issued to the respondents, in exercise of the writ jurisdiction to concrete or tar the temporary road. In the result, the writ petition is dismissed with no order as to costs.
