By this application, the applicant is seeking the condonation of delay of 207 days in filing appeal before this Court.

Learned Counsel for respondent No.1 though vehemently opposed the application, he has stated that it is the intentional delay on the part of appellant to approach before this Court and in case such delay is condoned, it should make clear that appellant will not be entitled for interest in case the First Appeal is allowed in his favour and amount is enhanced by this Court for the period from 23.11.2017 till the passing of the order on this application. 3.

Learned Counsel for the appellant fairly conceded that he will not claim interest in case First Appeal is allowed for the aforesaid period. Hence, the application is allowed.

It is made clear that in case the First Appeal is allowed and amount of compensation is enhanced by this Court, the appellant will not be entitled for interest for the period from 23.11.2017 till the passing of the order on this appeal.
