This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested on 22.10.2021 in Crime No. 323/2021 registered with Tamgaon Police Station, Tal.Sangrampur, Dist. Buldana for the offences punishable u/ss. 302, 301 r/w.34 of the Indian Penal Code.

Learned Advocate for the applicant has invited my attention to Page No.110 of the Paperbook, in order to point out that the mother of the applicant has filed a say before the learned Sessions Court giving "no objection" for releasing the applicant/accused on bail. He further submits that if the trial proceeds, the witnesses will turn hostile. 3.
The learned APP submits that the applicant is accused of patricide. He has rightly contended that the submissions made by the learned Advocate for the applicant clearly suggest that there is every possibility that the applicant has pressurized his mother to file an affidavit in his support and
BA.1453.22 the further submission that the witnesses will turn hostile is indicative of the fact that the witnesses will also be pressurized if the applicant is released on bail.
It is thus risky to release the applicant at this stage. 4.
