The writ petition is disposed of with the consent of the learned counsel for the parties on the following terms :- (i) The respondent no. 3 would permit the deduction of Rs.3.50 lac from the amount payable to him towards the retiral dues, as the said amount is liable to be paid to the petitioners towards arrears of maintenance.

(ii) The amount of Rs.3.50 lac shall be deducted by the respondent no. 2 from the retiral dues of the respondent no. 3 and the said amount would be paid by the respondent no. 2 to the

1503wp286.16 petitioner no. 1 towards the arrears of maintenance payable by the respondent no. 3 to the petitioners no. 1 and 2. The balance amount payable to the respondent no. 3 towards the retiral benefits should be released by the respondent no. 2 to the respondent no.3, as early as possible.

(iii) In the circumstances of the case, there shall be no order as to costs.
