The applicant apprehends arrest in connection with Crime No.1273/2018 registered by the non-applicant for the offence punishable under Sections 307, 353, 225 of the Indian Penal Code read with Section 184, 119, 177 of the Motor Vehicles Act. The crime is registered on the complaint lodged by Nayak Police Constable Nilesh Telrandhe. According to the complainant, while on duty at police station, he received information that two absconding persons Gulshan Pawnikar and Sachin Kinnake were present at Shivaji Market, Indira Gandhi Ward, Hinganghat and, therefore, he went to Shivaji Market alongwith other staff. On reaching Shivaji Market, he saw one Scorpio vehicle, the accused ran towards the vehicle and started driving it and when accused was asked to stop the vehicle, he gave dash to the vehicle of
2 aba714.18 complainant and attempted to drive the vehicle on the police party.
Learned A.P.P. has pointed out certificate issued by the doctor after medical examination of complainant showing contusion injury below left knee joint of the complainant. It is pointed out that about 18 crimes are registered against the applicant, out of which seven crimes are registered under the provisions of Indian Penal Code, including Section 307 and Section 302.
The Advocate for the applicant has submitted that out of 18 crimes, the prosecution in four cases has culminated in acquittal and in a couple of cases, the witnesses have turned hostile.
The application is opposed on the ground that two co-accused are absconding.
On examining the matter, I find that the accusations against the applicant are of very serious nature and investigation is in progress.
The application is dismissed.
